Types of Information We Collect

It can include, without limitation: your internet protocol (IP) addresses and/or domain names of the computers, mobile and other devices used by you, the Uniform Resource Identifier (URI), the time of the request, the method utilized to submit the request to the server, the size of the file received in response, the numerical code indicating the status of the server’s answer (successful outcome, error, etc.), your location and country of origin, your Internet browser, and operating system used Service Provider and their domains or network, time and page details per visit, information about marketing and conversion data, and other statistical data, reports, and analytical data. Personal Data. In addition to Usage Data, we collect Personal Data provided by you. “Personal Data” includes any data used directly to identify you. Personal Data may include one or more of the following: name, address, email, occupation, employer, phone number. It may also include any information you have disclosed on social media or by telephone, regular mail, or email.

You may enjoy the benefits of this website, including reading blogs and articles, watching videos, and listening to interviews and talks, without providing any Personal Data.

Any information you disclose in connection with e-therapy, coaching, or psychotherapy services pursuant to a Coaching Agreement and/or Intake and Feedback forms, including, without limitation, information communicated by phone, fax, or Skype, and client notes, emails, and billing statements is included in Personal Data, but is subject to such Agreement and forms and Federal and California laws applicable to such professional services.

How Personal Data is Collected. We collect Personal Data that you provide in connection with account registration, products, services, promotions, or a website or blog subscription. We collect Personal Data when you comment on this website or communicate with Darlene Lancer by email, telephone, Skype, fax, regular mail, and/or through social media messages. When you create an account, cancel or complete a purchase, request a product or information, comment on or subscribe to the website blog, respond to a promotion, or complete a form subscribing to our website, blog, or mailing list, we will receive your Personal Data from the website, our email services, and/or autoresponder service.

Your Right to Change and Update. You may contact us to find out what Personal Data we have collected about you and what information, if any, we have shared with third parties for marketing purposes. You may request changes or update your Personal Data. We securely retain your Personal Data, subject to your right to opt-out or be forgotten. If you have created an account and password on this website, only you may update that information.

Your Right to Opt-Out. We take your privacy seriously. You always have the opportunity to opt-out of our email marketing (Marketing Campaign) or other communications with you. You may notify us by telephone or email to be removed from our mailing list or unsubscribe using the link at the bottom of any marketing email. If you used two different email addresses when interacting with this website or Darlene Lancer, be sure to unsubscribe for both email addresses. If you created an account when making a purchase or interacting with this website, you must close your account if you want your email and Personal Data removed from the website. We maintain a list of people who have unsubscribed from our mailing list in order not to email them again. If we mistakenly email you after you have unsubscribed, please notify us immediately so we may rectify the problem.

Blog Subscriptions: Remember that a blog subscription differs from our mailing list. However, if you subscribed to this website mailing list, you were automatically subscribed to receive monthly blog posts. To unsubscribe from the blog, you may use the link at the bottom of the monthly email you receive. If you subscribed through an RSS feed, such as Google feed, click the unsubscribe link on your feed. Canceling your blog subscription will not remove you from the mailing list.

Website Accounts: If you have created an account with a password on this website, only you may delete that account. An account differs from subscription to the mailing list or blog subscription. If you don’t want to receive emails or monthly blog posts, follow the instructions above.

Your Right to Be Forgotten. If you wish your Personal Data completely deleted and forgotten, specifically notify us of this by email, and we will promptly honor your request unless you are a current or former client, in which case we are required by California law to keep your records on file for a minimum of seven years from the termination of services.

Use of Your Information

Personal Data is used in connection with our Marketing Campaigns and to complete the services or transactions you requested or initiated. Unless you unsubscribe as part of a Marketing Campaign or request that we don’t contact you by email, we may email you periodically (usually annually or semi-annually) announcements of new blogs, articles, webinars, audios, products, promotions, and/or services that we may offer. Additionally, we may use your Personal Data for our private, internal website reporting, and security assessments for this website. We may use Usage Data to provide you better service, to customize the website based on your preferences, to gather and analyze statistics about the use of this website, to market products, and to administer and improve this website for your use, as described below. We do not sell nor license your Personal Data but use it only as stated herein.

We may provide access to your Personal Data and Usage Data to subcontractors who assist in its collection, storage, Marketing Campaigns, processing payments, data analysis, and in connection with the operation and maintenance of this website. For example, we may contract with third parties to process payments, host our servers, provide security, and provide production, fulfillment, optimization, analytics, and reporting services.

Social Media. We encourage you to socialize and share your activities with this website and in making purchases. If you choose to use social media platforms such as Facebook, Twitter, Pinterest, Tumbler, Instagram, LinkedIn, and others you will be allowing interaction with external platforms directly from this website. In the process, you may be sharing certain profile elements, including your comments. This sharing is subject to each social media program’s privacy policies.

Affiliate and Associate Programs. As an Amazon Associate I earn from qualifying purchases. Occasionally, Darlene Lancer partners with professionals in presenting seminars and webinars. You have the option to join as a participant, which may entitle you to purchase and/or receive free bonus items from other presenters. In doing so, you may be sharing your information with third parties we do not control. With either of these programs, your Personal Data and Usage Data will be subject to the privacy policies of Amazon or the professional affiliate. Assume that we have an affiliate relationship with the producers of that product or service and may receive compensation from sales.

Successors and Assigns. If we sell, assign, license, or otherwise transfer part or all of this website, our business or assets or if it is transferred to Darlene Lancer’s heirs, executor, trustees, administrator, or legal representative, we may transfer your Personal Data and Usage Data in compliance with this Privacy Policy. All rights in this Privacy Policy will inure to the benefit of any and all such transferees.

Legal Process and Enforcement. We reserve the right to disclose your Personal Data and Usage Data when reasonably necessary in connection with any applicable law or regulation, to prevent unlawful activities, and to investigate, implement, and enforce our rights, including without limitation, to collect money owed, to initiate or respond to a legal process or governmental inquiry or request, and to protect the security of this website.

Cookies and Web Beacons

To service you and improve your experience on our website, we may use “cookies” and “web beacons” to collect and save Usage Data regarding your activity at our website.

Cookies. A cookie is HTML data sent from a website and stored on your computer, phone, or other device by your browser while using this website. Your browser then informs our website when you return. Cookies don’t contain Personal Data. They are only read by website servers. They were designed for websites to recall Usage Data or to record your browsing activity. Web Beacons. A web beacon is a technique used on web pages and Marketing Campaign emails to check whether a user has accessed website content. They may be used to deliver cookies, collect Usage Data, and monitor user activity on this website for the purpose of website analytics. We may also employ web beacons from service providers and third parties in order to help us aggregate statistics regarding Marketing Campaigns and other website functions. For example, they help determine whether you opened or clicked on content in Marketing Campaign emails.

Necessary Cookies. We use cookies that are necessary to help you navigate the website, including Paypal cookies to facilitate purchases.

Analytics. We reserve the right to engage third parties, including but not limited to WordPress and Google Analytics, to obtain, monitor, and analyze your activity on this website. For example, Google collects cookie and Usage Data, such as IP addresses, user location, and demographic data, the duration of each visit, what search engine is used, the source of the user, what links are clicked, and what search term was used. Google sends this data to Google Analytics to provide insights about how users find and use our website, create reports on user activity, and to share that data with Google’s services.

Google registers a unique ID that identifies a returning user’s device. The ID may be used by Google for targeted ads according to your preferences. However, to protect your privacy, we have attempted to anonymize the collection of your IP address. Analytic data collected by Google is retained for 26 months from the user’s most recent visit. We do not currently use Google Adwords for advertising that collects similar data, but may in the future. For more information about Google’s Cookie and Usage Data, visit Google’s Privacy Policy. You may opt-out of the Google Analytics service with Google’s Browser Add-on. You may opt-out of Google Adwords at Google Ads.

Marketing. We and our marketing partners and service providers use analytic cookies in email Marketing Campaigns (see “Use of Your Information) to evaluate the effectiveness of a campaign and to determine whether you have opened the email, clicked on a link, or unsubscribed from our mailing list. There will be an unsubscribe link at the bottom of all marketing emails. We do not use cookies to otherwise advertise to you.

Social Media. We embed a Facebook widget to allow you to see the number of likes/shares/recommends and “like/share/recommend” on our webpages. We may collect your IP address and web browser, store and retrieve cookies on your browser, embed additional tracking, and monitor your interaction with Facebook, including correlating your Facebook account with actions you take, such as “liking/sharing/recommending” our webpage if you are logged in to Facebook. We do not currently use Facebook Custom Audience Ads for advertising, but may in the future, in which case some of your Personal Data is shared with Facebook to determine if you have a Facebook account. You may opt-out of Facebook Custom Audience Ads on the under Settings: Ads on your Facebook profile and by emailing us to eliminate you from Facebook Custom Audience advertising campaigns.

Youtube collects your IP address, location, and statistics on which videos you’ve watched, and estimates your device’s bandwidth on pages with integrated YouTube videos. You may opt-out of Youtube’s tracking.

Data Security

Your personal privacy is important to us. We endeavor to safeguard your Personal Data from unauthorized access and use not permitted in this Privacy Policy. Nonetheless, the privacy and security of electronic storage and transmission via the Internet cannot be guaranteed. However, we undertake reasonable efforts to keep your Personal Data secure in accordance with generally accepted industry standards.

Additionally, email and phone communication is not encrypted or secure and may be accessed by unauthorized people and automated technologies. Hence, the privacy and confidentiality of such communications can be compromised. Servers have unlimited access to all emails that go through them. If you contact Darlene Lancer requesting help or information via email, it is assumed that you understand and consent to the risks involved. If this concerns you, it is recommended that you consult Darlene Lancer by telephone, not email. A landline is more secure than a cell phone.

Personal Data we collect is stored by Darlene Lancer and by servers in the United States. If you live outside the United States, you consent to transfer of Personal Data to the United States for such purpose.

You represent that you are at least the age of majority in your state or province of residence and consent to allow any of your minor dependents to use this website.
